These Terms and Conditions (“Agreement”) govern the use of services provided by Mamba Express UG (“we”, “us”, “our”) through our website, digital platforms, and communication channels (collectively, the “Services”). By accessing or using our Services, you agree to be bound by this Agreement.

1. Acceptance of Terms

By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, our Privacy Policy, Disclaimer, Legal Waiver, and Communication Policy (collectively referred to as the “Supporting Documents”). Your agreement to these Terms is also considered full acceptance of all five related documents.

2. Scope of the Agreement

For the purposes of this Agreement and all Supporting Documents:

The terms “we,” “us,” or “our” shall collectively refer to:

• This website and any current or future URLs representing the brand;

• The brand name “Mamba Express UG”;

• Any unregistered or developing entity operating under or associated with the brand;

• Any individual, whether active or no longer involved, whose personal contact details (including phone numbers, email addresses, names, or social media handles) are or have ever been attached to our systems, platforms, frameworks, communication channels, third-party tools, plugins, or social media pages.

This scope is acknowledged and accepted by the user as applying to all legal, technical, and operational matters within this Agreement and all Supporting Documents.

3. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to use our Services. By accessing our Services, you represent and warrant that you meet these eligibility criteria.

4. Company Status and Website Information

• Not Legally Registered: Mamba Express UG is currently an unregistered startup concept in development. We are not yet a legally recognized company or incorporated entity.

• Website Under Construction: The contents of this website are provisional, incomplete, and subject to change.

• No Legal Reliance: Users agree that any reliance on content, statements, or representations made on the site or platforms is entirely at their own risk.

5. Account Registration

If account creation becomes necessary, users must provide accurate, complete, and current information. You are fully responsible for safeguarding your login credentials and for all actions taken under your account.

6. Use of Services

You agree not to:

• Use the Services for unlawful purposes;

• Violate any local, national, or international laws;

• Interfere with the functionality or security of our platforms;

• Misuse any information or tools made available through our Services.

7. Communication Restrictions

• Designated Channels Only: Communications are only valid if made through the official “Contact Us” form on the website. Any other method (email, DMs, comments) is not recognized.

• Emails Not Legally Binding: Communications made through our official emails are handled by human agents and may contain mistakes. No promises, commitments, or guarantees made via email are legally binding.

• No External Platform Responsibility: Any communications made via social media or third-party platforms (e.g., LinkedIn, WhatsApp, Instagram) are not official and must be taken at the user’s own risk.

8. Payments and Transactions

Mamba Express UG does not currently process payments for services or job applications. If payments are made through third-party platforms based on agent communication, you agree that we are not responsible, liable, or in any way involved in those transactions.

9. Privacy and Data Handling

Please refer to our Privacy Policy, which details how we collect, use, and attempt to protect your personal data. By using the Services, you acknowledge and accept the limitations of data safety due to our current developmental stage.

10. Limitation of Liability

• Use at Own Risk: Our Services are provided “as-is.” No warranties, express or implied, are made.

• No Legal Liability: To the maximum extent permitted by law, we shall not be held responsible for any damages, losses, or issues arising from your use of the Services.

• No Class Actions or Lawsuits: All legal complaints will be resolved via arbitration in Uganda and not through the court system.

11. Disassociation from Third Parties

If a user is referred to an external website, organization, or testing service by any of our agents or emails, you accept that:

• We are not in partnership, collaboration, or communication with that third party;

• We do not earn from or participate in any payment or data process involving that third party;

• Any money, time, or data submitted to them is done at your own risk.

12. No Responsibility for Hiring Communications

If you’re part of a hiring or job application process:

• We are not responsible for agent errors, miscommunication, or promises;

• We do not charge any money for hiring-related services or tests;

• If expenses arise during the hiring process (e.g., for a test or certificate), we are not liable, as these are third-party procedures beyond our control.

13. Indemnification

You agree to defend, indemnify, and hold harmless Mamba Express UG and all individuals covered under the Scope from any legal claims, losses, damages, or liabilities arising out of your actions, misuse of the Services, or violation of this Agreement.

14. Termination

We reserve the right to restrict, suspend, or terminate your access to any part of our Services without notice if we believe you have violated these Terms or any Supporting Document.

15. Modifications to Terms

We may revise or update these Terms and any of the Supporting Documents at any time. Your continued use of the Services following such changes constitutes your acceptance of the new Terms.

16. Governing Law and Arbitration

These Terms are governed by the laws of Uganda. All disputes shall be resolved exclusively through confidential, binding arbitration in Uganda, and not through any public or civil court.

17. Final Note

By accessing and using this site, you accept all of the above, including our Scope, and acknowledge that you have agreed to and accepted all five legal documents (Terms and Conditions, Disclaimer, Privacy Policy, Legal Waiver, and Communication Policy). You also agree not to pursue legal action based on the company’s unregistered status, the construction stage of its systems, or the personal details of any individuals connected to it.
